Agreement and scope
This Rights & Content License Agreement (“Agreement”) is between you, the contributor, and UrAvgCoach LLC (“UrAvgCoach,” “we,” “us,” or “our”).
This Agreement applies to written articles, article ideas, drafts, photographs, illustrations, charts, graphics, video, audio, data, screenshots, documents, and other materials that you provide to UrAvgCoach through the Writer Portal, email, file upload, or another agreed submission method.
Submission of material does not guarantee that UrAvgCoach will review, accept, edit, publish, promote, or continue displaying that material.
Definitions
You retain ownership of your original work
Except for rights you grant under this Agreement, you retain the copyright and other ownership rights you hold in your Original Content.
Submitting an article to UrAvgCoach does not by itself transfer ownership of your copyright to UrAvgCoach.
License you grant to UrAvgCoach
When you submit Content, you grant UrAvgCoach a non-exclusive, worldwide license to use that Content for editorial review and, if accepted, for publication and promotion connected with UrAvgCoach.
This license permits UrAvgCoach to:
- review and evaluate your submission;
- edit, proofread, format, crop, resize, caption, organize, and prepare the Content for publication;
- publish and display accepted Content on UrAvgCoach websites and digital properties;
- include accepted Content in newsletters and other UrAvgCoach editorial communications;
- use reasonable excerpts, headlines, images, thumbnails, quotes, and previews to promote the publication;
- promote accepted Content through UrAvgCoach-controlled social media accounts and other marketing channels;
- maintain archival copies of Published Content;
- adapt the technical format of the Content as necessary for different devices, platforms, or media formats.
UrAvgCoach does not receive the right to sell your copyright itself or claim authorship of your Original Content solely because you submitted it.
Photographs, video, graphics, and other media
You may submit supporting media only when you have sufficient rights to provide that media for the intended editorial use.
Original media
You may provide photographs, graphics, video, or other media that you created yourself, provided you have not previously granted rights that would prevent the proposed UrAvgCoach use.
Licensed media
You may provide properly licensed media when the applicable license permits the intended editorial and promotional uses. You are responsible for understanding and complying with any attribution, usage, geographic, duration, or other restrictions attached to that license.
Permission-based media
You may provide media owned by another person or organization when you have documented permission covering the proposed use.
UrAvgCoach may request proof of ownership, license, permission, attribution requirements, or source information before publishing submitted media.
Third-party copyrighted material
Do not submit third-party copyrighted material unless you have the rights, license, permission, or another valid legal basis necessary for the proposed use.
Examples that may require permission or licensing include:
- professional or commercial photography;
- broadcast footage;
- television or streaming clips;
- photographs taken by another photographer;
- copyrighted charts or illustrations created by another publisher;
- screenshots containing protected third-party material;
- copyrighted training documents or presentations;
- logos, artwork, or graphics you do not own;
- substantial excerpts from another person's writing.
A link to material on the internet does not necessarily mean that material is free to republish.
What you promise when you submit Content
By submitting Content, you represent that, to the best of your knowledge:
- the information you provide about yourself and your submission is accurate;
- you created the Original Content you identify as your own;
- you have sufficient rights or permission to provide all submitted Content;
- publication of the Content as contemplated by this Agreement will not knowingly infringe another person's copyright, trademark, privacy, publicity, or other legal rights;
- you have accurately disclosed material sources, quotations, collaborators, coauthors, licenses, permissions, and required attributions;
- the Content is not knowingly defamatory or unlawfully deceptive;
- you have authority to enter into this Agreement.
If your Content discusses identifiable athletes, patients, clients, students, minors, private medical matters, confidential records, proprietary team information, or other sensitive subjects, you are responsible for ensuring that you have appropriate authority and permission to disclose that information.
Editorial review and editing
UrAvgCoach may edit accepted Content for grammar, spelling, organization, readability, length, formatting, headlines, search presentation, consistency, factual clarity, house style, and other editorial purposes.
We may ask you to revise or clarify portions of a submission before publication.
Material changes to an author's substantive position should generally be discussed with the contributor when reasonably practical.
UrAvgCoach may decline a submission at any stage, including after editorial review.
Publication and promotion
Acceptance of an article idea, request for a draft, editorial correspondence, or receipt of a completed submission does not guarantee publication.
If UrAvgCoach publishes your Content, we may display your name, contributor profile, biography, professional role, organization, profile photograph, and approved public social or website links alongside the article.
UrAvgCoach may determine publication timing, placement, headline presentation, category, tags, featured status, homepage placement, newsletter inclusion, and promotional treatment.
Published Content may remain available in UrAvgCoach archives after it is no longer actively featured.
Compensation
Unless UrAvgCoach and the contributor separately agree in writing to compensation for a specific assignment or submission, participation in the UrAvgCoach contributor program does not by itself create an obligation for UrAvgCoach to pay the contributor.
If compensation is offered for a specific assignment, the applicable amount, eligibility requirements, payment method, and other terms should be communicated separately.
Withdrawal, corrections, and removal
Before publication, you may contact UrAvgCoach to request withdrawal of a submission that has not yet been published.
After publication, you may request a correction, update, or removal. UrAvgCoach will consider reasonable requests, but publication history, editorial integrity, technical limitations, legal obligations, archival needs, and other circumstances may affect whether or how a request is implemented.
UrAvgCoach may correct, update, unpublish, restrict access to, or remove Content when we reasonably believe doing so is appropriate for editorial, legal, safety, technical, or policy reasons.
Responsibility for submitted material and claims
You are responsible for ensuring that you have the rights and permissions you represent that you have.
If a third party raises a claim relating to Content you submitted, you agree to reasonably cooperate with UrAvgCoach in investigating the claim and, when appropriate, provide documentation supporting your ownership, license, permission, source, attribution, or other basis for use.
To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, costs, or claims arising from a material breach of the promises you make in this Agreement.
Nothing in this section is intended to make you responsible for changes independently introduced by UrAvgCoach that materially create a legal violation that was not present in your submitted Content.
Contributor records and account information
UrAvgCoach may maintain records associated with your writer account and submissions, including your name, email address, contributor profile, submission history, agreement version, agreement acceptance, electronic signature record, timestamps, editorial notes, and publication history.
Account information used for administration or editorial communication is not automatically made public. Information specifically designated for your public contributor profile may be displayed with Published Content.
Additional information about how UrAvgCoach handles personal information may be addressed in the applicable UrAvgCoach privacy policy.
Electronic acceptance and signature
The Writer Portal may ask you to type your full name, check an agreement box, and submit the account form electronically.
By completing that process, you indicate your intent to accept this Agreement and associate your typed name with your acceptance.
UrAvgCoach may retain an electronic record showing the agreement version accepted, the name entered as the signature, the date and time of acceptance, and related account or security information reasonably used to document the transaction.
Changes to this Agreement
UrAvgCoach may update contributor terms as the Writer Portal and publication program evolve.
Each version should have an effective date or version identifier. If we make material changes that require renewed contributor acceptance, the Writer Portal may ask you to review and accept the updated version before making additional submissions.
The agreement applicable to a particular acceptance record will be the version identified in that record.
Questions and rights documentation
If you are uncertain whether you have permission to submit a photograph, video, graphic, quotation, document, or other third-party material, contact UrAvgCoach before submitting it.
UrAvgCoach may request supporting documentation before publishing material when ownership or licensing is unclear.
Questions about this Agreement can be submitted through the contact options available on UrAvgCoach.com.
